Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the Voice-AI calling platform and related services (the "Service") provided by The Affordable AI ("we," "us," or "our"). By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service

The Affordable AI provides a voice-AI platform that dials leads, answers inbound calls, qualifies callers, delivers warm transfers to agents, books appointments, and syncs results to your connected CRM. Features include number provisioning and warmup, spam and voicemail defense, multi-calendar routing, call recording and transcription, and native automations. We may add, modify, or remove features over time.

Accounts & Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account.

Acceptable Use

You are responsible for your calling campaigns and for ensuring they comply with all applicable laws and regulations. In particular, you agree to:

• Comply with the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and all other applicable calling and telemarketing regulations;
• Honor Do-Not-Call (DNC) lists and maintain your own internal DNC records;
• Obtain any consent required before calling, recording, or transcribing;
• Not use the Service for illegal, fraudulent, harassing, deceptive, or abusive calls;
• Not use the Service to transmit unlawful, infringing, or harmful content; and
• Not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

You — not The Affordable AI — are solely responsible for the content of your calls, your lead lists, your compliance posture, and the outcomes of your campaigns. We may suspend or terminate accounts that violate these requirements.

Fees & Billing

The Service is offered on a subscription basis combined with per-minute usage charges, plus a one-time setup fee where applicable. Subscriptions are billed monthly or annually in advance, and usage minutes are billed according to your plan's per-minute rate. There are no long-term contracts; you may cancel anytime to stop future subscription charges. All payments are processed through Stripe. You authorize us to charge your payment method for all applicable fees. Fees are exclusive of taxes unless otherwise stated.

Number Provisioning

Phone numbers used with the Service are provisioned and managed through Twilio. Your use of provisioned numbers is subject to Twilio's applicable terms and acceptable use policies, as well as carrier requirements. Numbers may be subject to warmup schedules, reputation management, and regulatory registration requirements.

Third-Party Services

The Service integrates with third-party providers, including Twilio, HighLevel, Google and Outlook calendars, Stripe, and Zapier. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Intellectual Property

The Service, including its software, design, and content, is owned by The Affordable AI and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain ownership of the data and content you provide.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific results, conversion rates, answer rates, deliverability, or uninterrupted or error-free operation. Telephony performance depends on carriers and other factors outside our control.

Limitation of Liability

To the maximum extent permitted by law, The Affordable AI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amounts you paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless The Affordable AI and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your calling campaigns, your content, or your violation of these Terms or applicable law.

Termination

You may cancel your subscription at any time. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees, or use the Service in a manner that creates legal or security risk. Upon termination, your right to use the Service ceases, though certain provisions of these Terms will survive.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the United States and the state in which The Affordable AI is established, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
